Attorney General Jeff Sessions issued a memo last week announcing that the Department of Justice will no longer interpret Title VII’s prohibition on sex discrimination as protecting transgender individuals, reversing the Obama administration’s stance. NYLAG is deeply disappointed with this decision. Fortunately, ample case law supports the idea that Title VII’s prohibition on sex discrimination clearly includes gender identity, and this memo does not have the power to undermine those decisions. However, we still condemn this action for what it is – the latest move by the Administration to undermine the rights and basic humanity of transgender individuals in the United States. Transgender people face discrimination in the workplace at disproportionately high rates, and the consequences of that discrimination can be devastating. We will continue to represent and support our trans clients in their fights for equal treatment in the workplace, and to advocate for expanded protections at national, state, and local levels.
