NYLAG applauds the signing of the Standby Guardianship law. Randye Retkin, the Director of NYLAG’s LegalHealth division, led the community coalition that designed and helped draft the newly expanded Standby Guardianship Law.
The bill amends the Surrogate Court Procedure Act to enable parents to appoint a standby guardian in the event of an “administrative separation”. An administrative separation is a federal immigration matter including an arrest, detention, incarceration, removal, deportation, or receipt of an official communication by authorities regarding immigration enforcement. With the signing of this new law, immigrant parents have the ability to make an appointment or designation of guardian that only takes effect upon a triggering event, the administrative separation, and enables parents to plan but not relinquish parental rights.
