Brief of Legal Services Organizations for United States Court of Appeals for the 9th and 2nd Circuits

NYLAG provides legal services to immigrants, including many clients who are youth who were eligible for the Deferred Action for Childhood Arrivals (DACA) program. Because of our work, we understand  the complex legal challenges now facing DACA grantees in light of the September 5, 2017 rescission of DACA, and know only too well the irreparable harm being inflicted on innocent people. If the district court’s preliminary injunction is lifted, any mitigating effect of the preliminary injunction will be lost.  Thousands of young people will face a frightening and uncertain future, despite prior assurances by the government that by coming forward and applying for DACA, they would be protected from negative immigration enforcement action. The vast majority of Dreamers will be left without any protection from deportation if the injunction is lifted and their current status expires. The injunction ordered by the district court serves the public interest and should remain in place.
