NYLAG’s Suit Extracts Public Records From U.S. Dept. of Veterans Affairs

NYLAG v. United States Department of Veterans Affairs

The U.S Department of Veterans Affairs (VA) is required to review what schools can receive veterans benefits. The VA is not allowed to approve schools that use false, deceptive, or misleading advertising, sales, or enrollment practices. To help figure out whether schools engage in such practices, the VA can refer schools to the U.S. Federal Trade Commission (FTC). There is little public understanding as to whether, how, or under what circumstances the VA does this, or whether, how, and under what circumstances it in fact disapproves the use of benefits at deceptive schools. NYLAG sought more information about these practices by filing a Freedom of Information Act request, but the VA did not respond, so NYLAG filed this lawsuit.

In July 2019, the VA finally provided the documents we asked for–linked below. We encourage all members of the public to make use of these records.
