Bennett v. NYCHA

Bennett v. NYCHA: U.S.D.C., E.D.N.Y.  Class action filed in 2002 challenging the failure of the New York City Housing Authority (“NYCHA”) to assist people with mobility impairments in making full use of their Section 8 vouchers.  While doing research for their papers in opposition to our motion for class certification, NYCHA discovered a 20 year-old case, Heyer v. NYCHA, making the same claims as Bennett, in which a class was certified and an injunction issued but never enforced.  The Heyer injunction did not include any monitoring.  The two consolidated cases were settled in 2006.  NYCHA has failed to provide required monitoring and as a result the court’s jurisdiction was extended to 2010 and we will review new monitoring to consider bringing a motion for contempt.  (JGS, JR)  (Counsel in Heyer: Legal Aid Society)
